As a double board-certified pediatric and adult psychiatry expert witness, I’ve seen firsthand how psychiatric testimony can significantly strengthen or clarify a medical malpractice case.
Psychiatric elements are often underappreciated in malpractice litigation, yet emotional harm, trauma, and long-term mental health consequences can be just as debilitating as physical injuries. Whether the case involves a misdiagnosis, delayed treatment, or a deviation from accepted standards of care, psychiatric evaluation provides a critical dimension: the psychological impact.
In malpractice cases, attorneys are often tasked with translating complex medical narratives into language that judges and juries can understand. This becomes especially challenging when psychiatric injuries are involved, as they are not visible on imaging or laboratory testing. As a pediatric and adult psychiatric expert witness, my role is to bridge the gap between clinical psychiatry and the legal process. I assess psychiatric causation, standards of care, and long-term outcomes, then explain those findings in clear, understandable terms.
For example, when negligent care results in post-traumatic stress disorder (PTSD), my evaluation documents diagnostic criteria, supports conclusions with peer-reviewed literature, and outlines how symptoms affect daily functioning. This allows attorneys to present a cohesive narrative that explains not only what the diagnosis is, but why it matters.
I also conduct independent medical examinations (IMEs) and comprehensive record reviews, offering unbiased, defensible opinions whether I am retained by plaintiff or defense counsel. My reports are written with litigation in mind — structured, evidence-based, and deposition-ready.
Psychiatric harm should never be an afterthought in malpractice cases. When mental health consequences are part of the injury, they deserve the same rigorous evaluation as physical harm.
